• Incorrect or unauthorized pricing
• Incomplete, inaccurate, or unverifiable billing or shipping information
• Transactions flagged as high-risk by our payment processor
• Prior violations of these Terms by the customer

You agree to provide current, complete, and accurate purchase and account information for all orders. You further agree to promptly update your account information to keep it accurate and current.

5. Payments

All payments must be fully authorized and cleared at the time of purchase. By submitting payment information, you represent and warrant that: (a) you are the authorized account holder or have explicit authorization from the account holder to use the payment method provided; (b) the payment information is true, correct, and complete; and (c) you will not dispute or reverse any charge for products or services that were delivered as described.

We are not responsible for transaction declines, fees, or holds imposed by your financial institution. Any fees resulting from chargebacks, disputes, or reversals initiated without valid cause under these Terms may be passed on to you.

6. Chargeback and Dispute Policy

You agree to contact Beautify directly at beautifyc9@gmail.com to resolve any order issues before initiating a chargeback, payment dispute, or reversal with your bank or payment provider.

Initiating a chargeback or payment reversal without first contacting us and allowing a reasonable resolution period of no fewer than five (5) business days constitutes a breach of these Terms. In such cases, Beautify reserves the right to:

• Submit documented evidence to the payment processor or card network to contest the dispute
• Recover the full disputed amount plus any chargeback fees, administrative costs, and legal fees incurred
• Permanently ban the customer from placing future orders
• Report fraudulent chargeback activity to relevant authorities

Beautify maintains detailed transaction records, order confirmations, shipping data, and delivery confirmations, which will be submitted as evidence in any dispute proceeding. You acknowledge that filing a false or unsupported chargeback may constitute fraud under applicable law.

7. Shipping and Delivery

Shipping timeframes provided at checkout are estimates only and are not guaranteed delivery dates. Actual delivery may vary due to factors including, but not limited to:

• Carrier delays or disruptions
• Customs clearance and import processing
• High-volume shipping periods or weather events
• Inaccurate or incomplete delivery addresses provided by the customer

Once an order has been transferred to the carrier and a tracking number issued, Beautify's responsibility for that shipment is fulfilled. We are not liable for lost, stolen, or delayed packages after carrier handoff. It is the customer's responsibility to ensure a secure delivery location. For lost packages, customers must contact the carrier directly.

8. Returns and Refunds

All returns and refunds are governed exclusively by our separate Refund Policy, which is incorporated into these Terms by reference. By placing an order, you agree to be bound by that policy.

We expressly reserve the right to deny any return, refund, or exchange request that does not comply with our stated Refund Policy. Approved refunds will be issued to the original payment method only. Beautify is not responsible for refund processing times imposed by your bank or payment provider.

9. Intellectual Property

All content on this website — including but not limited to text, product descriptions, images, branding, logos, graphics, and designs — is the exclusive property of Beautify and is protected under applicable copyright, trademark, and intellectual property laws. Unauthorized copying, reproduction, modification, distribution, or commercial use of any content, in whole or in part, without prior written permission from Beautify is strictly prohibited and may result in legal action.

10. Prohibited Uses

You agree that you will not use this website or its services:

• For any unlawful, fraudulent, or harmful purpose
• To violate any applicable local, state, national, or international laws or regulations
• To infringe upon or misappropriate any intellectual property rights

Beautify reserves the right to immediately terminate your access, cancel pending orders, and pursue all available legal remedies for any violations of this section.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THIS WEBSITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

IN ALL CASES, BEAUTIFY'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE WEBSITE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO BEAUTIFY IN THE NINETY (90) DAYS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, liability is limited to the fullest extent permitted by law.

13. Indemnification

You agree to defend, indemnify, and hold harmless Beautify and its owners, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or access to the website; (b) your violation of any provision of these Terms; (c) your violation of any applicable law or regulation; (d) any false, fraudulent, or unauthorized transaction or chargeback initiated by you; or (e) any content you submit or transmit through the website.

14. Third Party Services

We may engage third-party service providers to facilitate payment processing, order fulfillment, shipping, analytics, and website operations. These third parties operate under their own terms and privacy policies, and Beautify is not responsible for their performance, availability, accuracy, or data practices. Your use of third-party services accessed through our website is at your own risk.

15. Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the website, or any products or services purchased from Beautify shall be resolved exclusively through binding individual arbitration, rather than in court, except as set forth below.

Informal Resolution First: Before initiating arbitration, you agree to first contact Beautify at beautifyc9@gmail.com and attempt to resolve the dispute informally for a period of not less than thirty (30) days.

Arbitration Process: If informal resolution fails, the dispute shall be submitted to binding arbitration administered under the rules of a recognized arbitration body. The arbitration shall be conducted in English, on an individual basis only. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver: YOU AND BEAUTIFY EXPRESSLY WAIVE THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION LAWSUIT, CLASS-WIDE ARBITRATION, PRIVATE ATTORNEY GENERAL ACTION, OR ANY OTHER REPRESENTATIVE OR CONSOLIDATED PROCEEDING. All claims must be brought in your individual capacity only.

Exceptions: Either party may seek emergency injunctive or equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration, without waiving the right to arbitrate the underlying claim.

16. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States and the state in which Beautify operates, without regard to conflict of law principles. To the extent any dispute is not subject to arbitration, you consent to exclusive jurisdiction and venue in the applicable state or federal courts.

17. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

18. Entire Agreement

These Terms of Service, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Beautify regarding your use of this website and supersede all prior or contemporaneous communications, whether electronic, oral, or written.
